Fan Content Policy

IMAGINE MAJESTY™ FAN CONTENT POLICY

Imagine Majesty Productions, LLC (aka “us,” “we” or “our”) encourages users to create and share Fan Content (i.e., stuff that you make using our intellectual property).  This Fan Content Policy and FAQ is meant to answer common questions about what you can and can’t do with our intellectual property (“Our IP”). The restrictions in this Fan Content Policy are intended to protect us and our games, which allows us to continually develop and distribute new games and features/content.
When using Our IP in your Fan Content, please follow these rules:
You can use Our IP (except for the restrictions listed in #4 below) to make Fan Content that you share with others for free. Free means FREE:

You can’t require payments or any other obligations or requirements (such as survey participation, the download of other software and/or content, subscriptions, registration, etc.) to access your Fan Content;

You can’t sell or license your Fan Content to any third parties for any type of compensation; and

Your Fan Content must be free for others (including us) to view, access, share, and use without paying you anything, obtaining your approval, or giving you credit.

You can, however, subsidize your Fan Content by taking advantage of sponsorships, ad revenue, and donations—so long as it doesn’t interfere with free access to your Fan Content.
Please make it clear that your Fan Content is unofficial, that is, not endorsed or sponsored by or otherwise affiliated with us. Please include a note with your Fan Content explaining that:

“[Title of your Fan Content] is unofficial Fan Content permitted under the Fan Content Policy and/or Game License of Imagine Majesty. Not approved/endorsed by Imagine Majesty. Portions of the materials used are property of Imagine Majesty Productions. © Imagine Majesty Productions, LLC.”

Please respect other people’s IP.  If you don’t have the legal right to use another person’s stuff in your Fan Content, don’t.  If we learn that your Fan Content also includes other people’s IP (e.g., crossovers/mashups) without their permission, we may ask you to take it down (if online) and/or otherwise stop distributing it.  By using Our IP according to this policy, you agree to comply with such requests.

Your permission to use Our IP is subject to the following additional requirements:

You must have agreed to the terms of the applicable Game License for that game or product, and to our Code of Conduct.  Copies of those documents are included with the IMAGINE MAJESTY™ game and can also be located at www.imaginemajesty.com/legal

Don’t use our logos and trademarks. We’ve included a list of our most frequently asked-about trademarks in the FAQ;

If Our IP that you are incorporating into your Fan Content already has copyright notices or other notices existing within it, don’t remove them;

Don’t use Our IP in other games. This includes your own or other people’s games or game components (e.g., rule books, tokens, figures), regardless of whether it is distributed for free;

Don’t use any video/animation and/or music that we provide in your Fan Content. Use of that material may be governed by agreements with third parties. Please don’t copy any of our video/animation or music content, unless you’re embedding a video from an authorized third-party;

We have the right to stop or restrict your use of Our IP at any time—for any reason or no reason—including when we think your use is inappropriate, offensive, damaging, or disparaging, or if it is confusing people regarding the source or sponsorship of your Fan Content, or if your Fan Content is creating competition with our products. If this happens, you must immediately take down your Fan Content.

Sponsorship of your Fan Content. We are fine with you using third-party sponsors to subsidize costs of producing Fan Content, if you follow a few rules:
Don’t use a sponsor that would be harmful to us. Please don’t promote our competitors or endorse inappropriate or offensive sponsors;
Make it clear (verbally or visually) that they are acting as a sponsor only;
Keep any shout-outs, credits, etc. to a reasonable length; and
Do not associate Imagine Majesty Productions with your sponsor in any way.

Because it’s your Fan Content, you are solely responsible for ensuring that your creations don’t violate the laws of your region or country, or the rights of others.  In addition to this Fan Content Policy, your use of Our IP may also be covered by (and by creating such Fan Content you agree to comply with) our Game License (“Our License”) and/or our Code of Conduct, copies of which are included with the IMAGINE MAJESTY™ game and which can also be located at www.imaginemajesty.com/legal.  Our License and Code of Conduct include important legal terms (such as limitations of lability, indemnification, and dispute resolution), so please review them carefully before producing Fan Content.  If there’s a conflict between this Policy and Our License or our Code of Conduct, the terms of Our License and Code of Conduct prevail.  

What we are permitting you to do under this Policy is to use Our IP in a limited manner, in a legally-permitted way.  This license can be revoked by us at any time, for any reason, without prior notice.  If Imagine Majesty Productions, our partners, affiliates, or employees are subject to any legal claims, fees, or expenses related to your Fan Content, you are responsible for paying all of our costs (including attorney’s fees) and any judgments or settlements that result from or are related to the legal claim or its adjudication (whether in court or by arbitration).

FREQUENTLY ASKED QUESTIONS

What kind of stuff does “Fan Content” cover?

Pretty much anything you create based on or incorporating Our IP.  Fan Content examples include custom templates, automata, fan art, videos, podcasts, blogs, websites, streaming content, fan fiction, etc.
The key is that Fan Content is your creation. Fan Content does not include the outright copying and reposting of Our IP (e.g., copying and distributing an IMAGINE MAJESTY™ game, game rules, or content, etc.), regardless of whether that content is distributed for free or not.  Your creation, copying, use, or distribution of such materials is always prohibited.

So then, what is “Our IP?”

Our IP includes, but is not limited to, the copyright in our game boards, cards, characters, creatures, books, games, gameplay, pictures, stories, icons (not including any logos or trademarks), animations, artwork, plots, locations, histories, characters, graphics, files, text, and other materials published by Imagine Majesty Productions, LLC.  Please note that some uses of Our IP may also fall under our Game License (e.g., creating customizations based on our game mechanics) and/or our Code of Conduct, and by using Our IP you agree that you have read and agreed to the terms of those agreements.
Can I use all of your IP?

Unfortunately, no. You cannot incorporate our logos or trademarks into your Fan Content without our prior written permission.

Please note, if a trademark or logo does not appear on the list above, this doesn’t mean that we waive any rights that we have established in any of our products, features, service names or logos.
Q: Can I create a fan page about your games? And use your art?

A: Yes! Just follow the policies outlined above.

Q: Does “Fan Content” include web videos and live streams?

A: Yes! Just follow the policies outlined above.

Q: My Fan Content is free to access, but may I take donations or derive ad revenue?

A: Yes! We know you put lots of time and energy into your Fan Content and are OK with you recouping some of that investment in the form of donations or ad/click revenue—so long as it follows this Policy and doesn’t interfere with free access to your Fan Content.

Q: What about partner programs with YouTube or Twitch that I earn money on? Is this allowed?

A:  Yes, you don’t need prior written permission from us to participate in these type of partner programs. For any other licensing of Fan Content that earns you compensation, you’ll need our advance written permission.

Q: May I include my Fan Content in my artistic portfolio? 

A: Yes, so long as you are not selling it and you make it clear that your work is not affiliated with Imagine Majesty Productions.

Q: May I sell my Fan Content online or at conventions? 

A: No. We are fine with you producing Fan Content for your own enjoyment, to give away as a gift, or to post pictures of online. But we don’t allow anyone to sell IMAGINE MAJESTY-related content without our express permission to do so.

Q: May I put a logo or trademark on a t-shirt or a hat, for my own personal use?

A: No.  You would need permission from us for that. You may not incorporate any of our logos and trademarks in your Fan Content without our prior, written consent.

Q: Does this mean that you can use and display my Fan Content?

A: Yes!  By making Fan Content, you agree to let everyone (including us) share and use your stuff without asking your permission.  We don’t want to get sued for spotlighting your Fan Content or making something that may resemble someone’s Fan Content.  Please also review our Game License for more information on this topic, as some Fan Content may fall under the terms of that agreement.

Q: Can I tag or share with you my Fan Content?

A: Yes! We hope you’ll show us the cool stuff you make. But please, DON’T send us your ideas for our games or for future products. Those will be deleted without review, and by sending us ideas you grant us a worldwide, perpetual, royalty-free license to use those ideas in any manner we see fit.  

Q: What constitutes “inappropriate, offensive, damaging, or disparaging” Fan Content that you’ll take down?

A: Anything that might reflect poorly on us or hurt our fans.  Our Code of Conduct outlines some examples. In short, we ask that you keep your Fan Content focused on our games and away from overtly controversial topics. Keep it (relatively) clean, please! And absolutely no racist, sexist, homophobic, transphobic, ableist, ageist or any other offensive content.

Q: My friends and I play IMAGINE MAJESTY™ online in private groups that require a login/sign in to access the game. Is this allowed under the Policy?

A: Yes. You can require a login/sign up to play a private group game, provided that all participants abide by any and all agreements governing the game (such as our Game License and Code of Conduct). That doesn’t violate our condition that you let others freely access Fan Content.

Q: How can I contact you about my Fan Content?

A: If your Fan Content isn’t permitted by this Policy, you’ll need our prior, written approval to use Our IP.  If the Fan Content you want to make isn’t covered by this Policy, or if you have any questions about whether your Fan Content is covered by this Policy, or to otherwise request permission to use Our IP, contact us at legal@imaginemajesty.com.  We’ll reply back as soon as we can.

Please understand that if you don’t hear from us, it does not mean we approve of your requested use of our IP; it probably just means your question is covered by the Fan Content Policy.
